Climb Education Pty Ltd, ACN 656 088 881, ABN 81 656 088 881 (subsequently referred to as “Climb”, “Climb Education”, “the Company”, “we”, “us” or “our”) is the owner of climbeducation.com.au (subsequently referred to as “the Website”).
In registering for Services provided by Climb Education, you (meaning the person, organisation or entity) are entering into an agreement with Climb Education which is bound by the Terms and Conditions outlined in this document.

Terms
By accessing our Website and Services, you are agreeing to be bound by these Terms of Service and all relevant laws and regulations which pertain to your local jurisdiction.
You must not use, or purchase, Services from us if you do not have the consent of a legal guardian who is 18 years of age or older.
If you do not agree to any of the Terms of Service you are prohibited from using or accessing our Website and Services.
The materials contained in this Website, and in our Services, are protected by applicable copyright and trademark law.
Acceptance of Terms and Conditions
The purchase of services from us, use of our Website, or direct contact with the Company indicate that you have had sufficient opportunity to access and assess our Terms of Service, and that you have chosen to comply with aforementioned Terms of Service.
Website Terms of Use
In using the Climb Education website, you agree to NOT:
- Violate the Intellectual Property Rights of Climb Education. All Intellectual Property displayed on the Website, or relating to the Company, are owned by Climb Education. This includes (but is not limited to): logos, typeface, art/icons, graphics, profiles, text, source code, wireframes, software, and resources.
- Reproduce, reformat, re-use, stream, communicate, distribute, sell, modify, store, and publish or otherwise, any of: the material, art/design, underlying source code or data that is on this Website.
- Use this Website for nefarious purposes to disrupt, contact, harass or annoy any individual (including third parties) that may receive communications as a result of your interaction with the Company or Website.
- Use any of the material, art/design, underlying source code or data (including tutor data) from this website for commercial purposes or personal financial gain.
- Submit any false (or misleading) information that is in violation of our Privacy Policy and /or Terms of Service.
- Attempt to gain access to, or interfere with, the optimal operations of the Website, or Company.
Climb Education will cooperate fully with relevant law enforcement authorities in any jurisdiction to disclose the identity, or other information, of any entity or individual who is in breach of any of the Terms outlined in this document.
Tutoring Terms of Service
In engaging with our tutoring services you are bound by the Terms of Service outlined in this document, as well all laws and regulations that are applicable to your jurisdiction.
If you do not agree to any of these Terms of Services then you are prohibited from accessing the Website, and any Services from Climb Education
You will purchase and engage in Services provided by the Company by using the booking, payment and communication platforms outlined by Climb.
You will treat all staff and clients associated with the Company with the utmost respect. Climb Education has a zero tolerance policy for any form of communication seen to harass, abuse or annoy any individual participating within the Company (as either an employee or client). There will be no warnings, if a complaint is lodged about your conduct you will no longer be a client at Climb.
Clients are entitled to contact our tutors within reason outside of tutoring hours via the dedicated channels of Google Mail and Google Classroom. Tutors will be expected to respond at their earliest convenience.
Payments Policy
Charges for each session will be determined by the Company in accordance with the relevant aspect of our pricing structure.
All payments will be made via the secure API/gateway provided by our secure payments partner Stripe. If you believe that any payment has been incorrectly invoiced or charged please contact us to discuss.
You will pay invoices from the Company within 72 hours of issue to ensure that sessions can run smoothly and will have significant time in advance to organise the session and allow our tutors/other clients to prepare for the session.
Any failed or late payment will be charged a $10 administration fee.
You will only be charged for sessions that are held, you will not be charged for any session that is cancelled/rescheduled with more than 24 hours’ notice. In the event that a group session is cancelled/rescheduled in less than 24 hours then only the client responsible for the change will be charged a $15 late cancellation/rescheduling fee.
The Company reserves the right to cancel any Services, or terminate your status as a client, in the event of repeated failure to pay invoices on time, frequent rescheduling or cancellation.
Cancellations and Rescheduling of Sessions
All clients are expected to be able to attend the agreed upon session on time and on a consistent basis.
All our fees and stipulated policies also apply to our 30 minute consultation sessions.
In the event that clients are unable to attend a session they are expected to notify the Company with more than 24 hours’ notice.
Rescheduling/cancellation that takes place with less than 24 hours’ notice then a $15 fee will be applied to the client requesting the late change.
If an emergency occurs (such as a sudden illness or medical procedure) please let us know, we will waive the fee in relation to this context.
In the event of repeated late cancellations/rescheduling then the Company reserves the right to cancel Services to that client.
In the event of a no-show with no provision of notice then the client will be invoiced the full cost of the booked session.
If a client arrives late to a session then the session will be conducted within the predetermined time frame stipulated in the booking. It is the responsibility of the client to ensure that they arrive at their booked session on time.
If a tutor is unable to attend the session we will attempt to ensure that a replacement is organised. If a replacement cannot be found then the session will be rescheduled or cancelled pending on client wishes. There will be no charge to clients associated with rescheduling/cancellation due to tutor non-attendance.
It is expected that clients are consistent in their approach to sessions, if more than 28 days has passed and no session has occurred then the client will be taken off our system.
Client Confidentiality and Personal Information
To register as a client with Climb Education you will be required to register some personal information, these include (but are not exclusive to): name, address, contact details, payment details.
Climb Education ensures that this data will be securely stored on our payment and client systems. If 28 days have passed since the last session with the Company has occurred then all personal client information and payment details will be removed from our systems.
All information provided to Climb Education and client is treated as confidential, any information related to learning that extends beyond the details stipulated in the Learner Profile and Learning Plan documents will only be provided to tutors upon client request.
Services Disclaimer and Academic Integrity
Climb ensures that all our tutors have a valid Working with Children Check, a validated ATAR score, have completed our training workshops, and operate in accordance with the Australian Tutoring Association (ATA) Code of Conduct ref: https://ata.edu.au/wp-content/uploads/2019/11/ATA-Code-of-Conduct.pdf
We are dedicated to providing the best possible services we can to clients. In the event that you are dissatisfied with our services please contact us and we will attempt to find a solution to your issues.
Unfortunately we are unable to provide refunds to services already provided, but we are happy to accommodate a change of tutor in the event that it may be necessary.
Our services are not to be used to assist a client with any form of plagiarism. We maintain a policy of academic integrity, our role as a Company is to facilitate academic growth and personal development of our clients. We will not write papers/essays/complete assignments on your behalf.
Under no circumstances shall the Company be liable for any damages caused by (but not limited to) your own academic dishonesty, misrepresentation of personal learning, or use/misuse of resources provided by the Company.
Climb reserves the right to discontinue service provisions to any client with immediate notice.
